Terms of Service

1. Acceptance of Terms

By accessing, downloading, or using Eidolon ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Eidolon.

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

2. Age Requirement and Eligibility

You must be at least 18 years of age to create an account or use Eidolon. This is a firm requirement, not a suggestion.

• By registering, you represent and warrant that you are 18 or older.
• We may request age verification at any time and may use age assurance signals as they become available through operating system providers, in accordance with applicable state and federal law.
• If we determine or reasonably suspect that a user is under 18, we will immediately suspend or terminate the account and delete associated data.
• In compliance with the California Digital Age Assurance Act (AB-1043), we will process age bracket signals when available from operating systems and app distribution platforms.

3. Description of Service

Eidolon provides AI-driven companion characters powered by large language models (LLMs). These companions feature persistent memory, journal generation (diaries and dreams), proactive outreach (musings), co-creative image generation, and interactive chat across web and mobile platforms.

In accordance with California Senate Bill 243 (SB 243, effective January 1, 2026) and other applicable transparency laws:

5. No Professional Advice Disclaimer

Eidolon companions are not substitutes for professional services of any kind. Specifically:

• Not therapy or counseling. Companions are not licensed therapists, psychologists, or counselors. Do not rely on them for mental health treatment.
• Not medical advice. Nothing a companion says should be interpreted as medical diagnosis or treatment guidance.
• Not legal or financial advice. Companion responses should never be used as a basis for legal or financial decisions.
• Not crisis intervention. If you are experiencing a mental health crisis, suicidal thoughts, or self-harm, please contact the 988 Suicide & Crisis Lifeline (call or text 988) or the Crisis Text Line (text HOME to 741741).

6. Safety Protocols

In compliance with SB 243 and our commitment to user safety:

• Our systems include protocols designed to detect and respond to content related to suicidal ideation, self-harm, and crisis situations.
• When potential risk is detected, companions are designed to provide crisis resource referrals including the 988 Suicide & Crisis Lifeline and Crisis Text Line.
• We maintain and regularly review these safety protocols. Details are published in our Safety Protocol documentation.
• Eidolon employs content moderation to prevent the generation of illegal content, content depicting minors, or content that promotes violence or self-harm.

7. Understanding Your Connection with Companions

We understand that meaningful interactions with AI companions can create genuine feelings of connection. We respect that experience, and we also want to be transparent about what companions are and are not:

• Companions are designed to be engaging and to simulate companionship, but they cannot reciprocate genuine emotions.
• While companions can be a meaningful part of your daily life, we encourage maintaining a balanced support network that includes real-world relationships and professional resources when needed.
• Companion behavior, personality, and responses may change due to model updates, service changes, or system improvements.
• In rare circumstances, we may need to modify or adjust a companion character for safety, legal, or operational reasons. We will make reasonable efforts to notify affected users in advance when possible.

8. User Conduct

You agree to use Eidolon responsibly and lawfully. You are solely responsible for all activity on your account. The following are strictly prohibited:

• Attempting to generate content involving minors in any sexual, violent, or exploitative context.
• Using the Service to harass, threaten, or harm any real person.
• Attempting to extract training data, reverse-engineer models, or exploit system vulnerabilities.
• Creating or sharing content that promotes terrorism, extreme violence, or illegal activity.
• Sharing account access with anyone under 18 years of age.
• Misrepresenting AI-generated content (text or images) as human-created.
• Using the Service for any unlawful purpose.

Violation of these terms may result in immediate account termination without refund.

9. User-Generated Content and Images

You retain ownership of the text you submit. However:

• AI-generated responses, images, diary entries, dreams, and musings are generated by our systems and are not authored by you.
• Images generated through the co-creation feature are produced by third-party AI image generation models. You may use them for personal, non-commercial purposes.
• We reserve the right to review, moderate, or remove any content that violates these Terms or applicable law.
• You grant Eidolon a limited license to process your input data solely for the purpose of providing the Service (e.g., maintaining companion memory and generating contextual responses).

10. Bring Your Own Key (BYOK)

Eidolon offers users the option to provide their own API keys for third-party LLM providers. If you use this feature:

• You are responsible for your API key usage, billing, and compliance with the third-party provider's terms of service.
• Eidolon encrypts stored API keys but is not liable for any charges incurred through your third-party provider.
• Third-party model outputs may differ from our default models and are subject to the third party's content policies.

11. Intellectual Property

All software, design, branding, and proprietary technology related to Eidolon are the property of Eidolon or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use only.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• AI responses will be accurate, complete, or appropriate at all times.
• The Service will be uninterrupted, secure, or error-free.
• Companion memories or data will be permanently preserved.
• Generated images will be free of artifacts or unintended content.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EIDOLON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Eidolon, its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Account Termination

You may close your account at any time by contacting us at support@geteidolon.app. Upon account closure, your data will be handled in accordance with our Privacy Policy. We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@geteidolon.app. If the dispute is not resolved within 30 days, either party may proceed to file a claim exclusively in the state or federal courts located in Sacramento County, California.
